TERMS AND CONDITIONS OF YOUR LEVERAGE REWARDS PROGRAM

TERMS AND CONDITIONS

The Your Leverage Rewards Program ("Program") is operated by YourLeverage.com ("Your Leverage Rewards", "us", "our", or "we"). When you enroll in the Program as a Collector of Your Leverage Rewards points, we licence you to collect reward points by dealing with participating Sponsors and to redeem the reward points in your Collector Account for travel, merchandise, gift certificates and other rewards ("Rewards") provided by participating Suppliers.

PARTICIPATION IN THE PROGRAM

Enrollment, membership and all related benefits of the Program are offered at our discretion. By enrolling in the Program or collecting reward points, you agree that you have read and understand these Terms and Conditions and are bound by all of them, as changed from time to time, and you consent to our collection and use of your personal information in accordance with our Privacy Commitment (see below). To enroll, you must have a valid address and be of legal age in the region in which you reside. If we accept your application for enrollment, we will establish an Account in your name and send you an Your Leverage Rewards Collector Card ("Card") when you begin to use your account. You may only collect reward points in one Account. Notify us immediately if your Card is lost or stolen. In case of divorce or relationship breakdown, death, emigration, duplication error, or with our authorization, you may with our prior consent and upon proper proof, merge your Account with the Account of a family member or member of your household. When merging Accounts, allow sufficient additional time for processing Rewards. The Program, including all reward points, Cards, every certificate or other document which can be exchanged for a Reward ("Certificate") and all rights relating to them, are and will remain our property. You may not sell, exchange, give, charge or otherwise dispose of any reward point. You are responsible for all taxes payable due to your participation in the Program, collecting and redeeming reward points and obtaining Rewards.

COLLECTION OF REWARD POINTS

You must identify yourself as a Collector and present your Card when dealing with Sponsors or participating businesses. We will credit your Account with only reward points you earn by dealing with authorized Sponsors in good standing with us, and only after the Sponsor requests us to do so. We are not responsible if a Sponsor delays or fails to make such a request or for any other delay in recording reward points in your Account. Some Sponsor or Supplier locations may not participate in the Program. We may refuse to record or honour reward points in your Account, or if already recorded, we may cancel them, if we cannot confirm that they were properly issued or obtained. We may also cancel recorded reward points if the issuing Sponsor does not pay amounts owing to us or tells us to cancel the reward points (for example, because you returned or didn't pay for products or services for which the reward points were issued). Sponsors will determine the conditions under which they will permit you to obtain reward points and may change those conditions at any time and without notice. Neither we nor any Sponsor is responsible for any offer of reward points which is no longer in effect. Any dispute must be settled between you and the Sponsor. If you believe that any Account Summary showing the number of reward points in your Account is in error, you must tell us within 60 days of the Summary date or it will be deemed correct, except for excess reward points improperly noted on it. We may require you to submit documentation to support your claim.

COMMITTED TO YOUR PRIVACY

We are committed to protecting your privacy. We collect and use your personal information to: (i) administer the Program, including the management of Collector Accounts, to accurately record and update reward point balances; (ii) process Collector redemptions, including the issuance of Rewards and Certificates; (iii) invoice Collector and Sponsor accounts, as appropriate; (iv) communicate information and offers to Collectors, Sponsors and Suppliers; (v) understand and analyze Collectors responses, needs and preferences; (vi) develop, enhance, market and/or provide products and services to meet those needs; and (vii) enable Collectors to participate in promotions and contests. Collector personal information is considered a Your Leverage Rewards asset; if our business is transferred to a new owner, Collector personal information will be given to and considered an asset of the new owner.

REDEMPTION OF REWARD POINTS

You can use the Your Leverage Rewards Customer Care Centre, and the Internet website portal to redeem reward points for Rewards. We recommend redeeming as early as possible as availability of some Rewards may be limited and depending on the Reward, there may be a minimum advance reservation requirement. An account number, or personal identification number (PIN) is required in order to access your account information and to redeem reward points on points.yourleverage.com or when calling us. Anyone who knows your Collector Account number and PIN will have full access to your Collector Account, and may change the address associated with your Account and redeem accumulated reward points. You are responsible for maintaining the secrecy of your PIN, for all activities that occur using your PIN and for notifying us of any unauthorized use of your PIN. We are not responsible or liable in any way for any loss arising from your failure to comply with these provisions. Account balances and reward point amounts required to obtain a particular Reward are subject to verification by the Customer Care Centre. You are responsible for and must pay all administration charges, taxes and service fees (including sales, VAT, departure and transportation taxes and fees, airport improvement fees, or other taxes), excess baggage charges, immigration fees, governmental fees and levies, customs charges and passenger facilities charges, health or other inspection fees, fuel surcharges and other nonticket costs or charges which may be imposed or collected with respect to Rewards requested by you or through your Account. Once tickets, Certificates or Rewards have been issued or shipped, no changes or refunds whatsoever are permitted, even if the ticket, Certificate or Reward is lost, stolen or destroyed. All Rewards are subject to availability and restrictions imposed by Suppliers. We assume no responsibility for any loss, damage, defect, injury, death or expense relating to any Reward, or for your Rewards not turning out as you expected for whatever reason.

ADDITIONAL TRAVEL DETAILS

Flight, Hotel and Car Rental reservations must be made and tickets issued at least 7 days in advance. All travel services are currently arranged by Fraser & Hoyt, a licensed travel agent in Canada. Reward points required for flight Rewards may vary due to routing and carrier availability, time and date of travel and use of multiple carriers. Generally, all flight tickets must be issued for round trip travel only and on the same airline, and various U.S. flights and all international flights require a Saturday night stay. The return portion of the flight must be booked at the time of booking your outbound portion. All travel must originate in Canada or the United States. Suppliers may limit length of stay and impose requirements to complete travel within a specified time after booking. En route stopovers are not permitted unless they are required to make specific connections. Trip cancellation and interruption insurance is highly recommended and must be purchased from us at time of booking to ensure the return of unused reward points to your Account. Availability of travel-related Rewards may be affected by Suppliers' blackout days, seating or space availability or other factors, meaning that seats or space for our Collectors may not be available even though the flight might not be full or the Rewards or Supplier services may not be fully booked. We may without notice alter or substitute airlines or scheduled travel times, omit or alter stopping places and routes, and are not responsible for making connections. We do not guarantee start or finish of travel. All reservations are subject to conditions of carriage, supply, and business of Suppliers which may include exclusions and limitations of liability. Times shown in timetables or elsewhere are approximate and not guaranteed. Schedules are subject to change without notice. We suggest you contact the participating airline in advance to confirm your departure times. We assume no responsibility if you are denied boarding, or your flight is cancelled or delayed. It is your responsibility to ensure you have all necessary passports, visas and travel documents and that you are aware of and meet all health requirements of your destination. Collectors may also redeem for Package Vacations and Cruises by redeeming reward points, or by using a combination of reward points and cash, or by using cash. Reward point and cash amounts required to obtain a particular Package Vacation or Cruise reward will be calculated on the basis of the best available price from our Suppliers at the time of booking. "Package Vacation" means flight plus accommodation for a minimum of 3 nights sold together by one supplier for a single price. Package Vacations and Cruises may be booked at any time without advance purchase requirements, subject to availability at time of booking, and must be paid in full at time of booking. No refunds, changes or transfers will be permitted after booking. Prices quoted are per person based on two adults sharing, unless otherwise indicated. Departure taxes, transportation fees, surcharges, port charges, all applicable taxes (including VAT) and an administration charge per person are additional and payable at time of booking.

BUY THE REWARD POINTS YOU NEED

At time of booking you may purchase a limited number of the total reward points required for any Reward, subject to change or withdrawal. No cash refunds. Our Customer Care Centre will advise you how many reward points you may purchase. You cannot purchase more reward points than required for the specific Reward.

BUSINESS COLLECTORS

Collectors who collect Your Leverage Rewards points in the course of making business expenditures may enroll as Business Collectors in the Your Leverage Rewards Program. Any individual, sole proprietorship, partnership or corporation which does so and has a valid address may enroll as a Collector by such individual or sole proprietor, or a partner in such partnership, or a director, officer or purchasing manager of such corporation, (each a Principal) following the procedures described below. Upon doing so, such Collector will be designated as a Business Collector. In addition, we may from time to time, at our option, identify Collectors who we believe have collected Your Leverage Rewards points in the course of making business expenditures and those Collectors will also be identified as Business Collectors. All Business Collectors will be entitled to the benefits and features outlined below. If we determine that a Business Collector has not been collecting for business purposes for any continuous 12 month period, we may, at our option, desiginate their business Collector Account to a non-business Collector Account, in which case such Collector will cease to be a Business Collector.

HOW TO ENROL

To enrol as a Business Collector, you may choose the "Grant Points" option at the internet website addree.  Enrolling as business gives you the ability to grant points to your clients as well as collect points from Sponsor and other participating businesses.

TRANSFER OF Your Leverage Rewards points

A Business Collector may not transfer Your Leverage Rewards points (recorded in its business Collector Account at the time of transfer) from its Business Collector Account to any Collector Account of a Principal, employee or family member of the Business Collector, or any family member of any such Principal, by providing us with written notice from a Principal of each such transfer.

REPLACEMENT BUSINESS COLLECTOR CARDS

In addition to the Business Collector Cards that are provided upon transactions in the Program, a Business Collector may request additional or replacement Card(s) for employees or other representatives of the Business Collector at a cost of $5.00 per Card plus shipping and handling. There is no charge for the first Card (in the Principal's name). For purposes of the Terms & Conditions of the Your Leverage Rewards Program, any person (other than the Business Collector itself) to whom any such additional Cards are provided will be an Additional Collector.

LIMITATION OF LIABILITY

Neither we, our partner businesses, our Sponsor, our affiliates nor any of our or their respective officers or directors have any responsibility or liability for any expense, loss, cost, injury, damage, delay, travel cancellation, accident or any other matter or thing whatsoever (collectively, "Costs"), however suffered or caused (including compensatory, incidental, indirect, special, punitive, consequential or exemplary damages or damages for loss of income or profits), directly or indirectly arising out of or related to (i) the Program or your participation in the Program; (ii) any failure, delay or decision by us in administering the Program or amending these Terms and Conditions or the basis on which you can redeem reward points; (iii) unauthorized use of your Collector Card or PIN; (iv) any offer, representation, statement or claim about the Program, any Sponsor or Supplier or their products or services, made by a Sponsor, Supplier or any other person; or (v) the purchase, redemption for or use of any goods or services of Sponsors or Suppliers, including any travel arrangements or other Rewards, whether made available by us, any of our affiliates, Sponsors, Suppliers or otherwise. This applies even if we or our representatives are advised of the possibility of such Costs. Sponsors and Suppliers are not responsible for the Program. Any liability we may have to you or anyone else who obtains the benefit of any reward points you redeem, under any circumstances, for any negligence, breach of contract or otherwise, is limited to crediting your Account with the number of reward points you redeemed in connection with those circumstances, or, if no reward points were redeemed, to a maximum of one-tenth of one cent for each reward point recorded in your Account when the liability arose. Use of our website is subject to the terms of use displayed thereon from time to time.

TERMINATION, CHANGES AND BREACH

We may change these Terms and Conditions, any aspect of the Program including booking conditions, redemption procedures or any Rewards in any respect, all without notice and even though changes may affect the value of reward points already accumulated. For example, but without limitation, we may add, delete or change Sponsors, Suppliers, participating airlines, time limits for collection, redemption or use of reward points, Certificates or Rewards; redemption conditions or procedures; or the number of reward points required for particular Rewards. If no reward points are recorded in your Account for 24 months, you become bankrupt, commit fraud, misrepresent any information, violate any Terms and Conditions, abuse your Program privileges or act in any other way to the detriment of us, our Sponsors or Suppliers or the Program, we may, without affecting our other rights, disclose such information requested by proper authorities, terminate your enrollment and/or cancel your reward points and Rewards. If a reward point or Reward expires or is cancelled for any reason, it becomes void without compensation.

GENERAL

These Terms and Conditions may be different from what you know about the Program. These Terms and Conditions constitute the entire agreement between you and us regarding your participation in the Program, your entitlement to collect and redeem reward points and your entitlement to any other benefits of the Program, and supercede all previous versions. Except as expressly contained in these Terms and Conditions, there are no conditions, representations, warranties, express or implied, statutory or otherwise. When you deal with us over the Internet, you consent to the formation of contractual relations through electronic communications. We are the final authority as to the interpretation of these Terms and Conditions and as to any other questions or disputes regarding the Program or any Reward. Unless we otherwise elect, any dispute regarding these Terms and Conditions, including validity, existence, binding effect, interpretation, performance, breach or termination, and including tort claims, shall be referred to and finally determined, to the exclusion of the courts, by a single arbitrator. The arbitration shall take place in English, and in accordance with international laws. The arbitration shall be conducted in strict confidence with no disclosure to any person of the fact of the dispute or any aspect of the dispute except as necessary for resolution of the dispute. We will not be taken to have waived any of our rights even if we redeem reward points or honour Certificates when not required. Reward points and Certificates have no cash, monetary or other value and cannot be converted into any currency. Your Leverage Rewards points are not actual points. They count towards travel, merchandise, gift certificates and other Rewards. All materials and any notices from us will be sent to your address as in our records; please notify us if your address changes. The Program, all rules and Terms and Conditions are governed by international laws. If any provision of these Terms and Conditions is invalid or unenforceable, such provision shall not affect the validity and enforceability of the remaining Terms and Conditions. 

“Us” and “We” means yourleverage.com, Your Leverage Rewards program, or its owners, operators, and or partners.

“Supplier” means the member business who is supplying the product that is being recorded

“Agent” means the selling agent or referral company for the product or service.

This website operates to track transactions and automate payments for its client, agent, and business membership. All members implicitly agree to be bound by these terms and conditions when applying for membership and using the site.

Membership is private and must be applied for by each applicant.  In the case of business members, there is a cost associated with membership.  Client memberships are free.  The owners and operators or yourleverage.com and Your Leverage Rewards are acting as exclusive agent for its membership, or yourleverage.com. Ownership may change, but the confidential information within the system will remain within the ownership unless the member explicitly expresses the consent to share this information.

We act as agents extending to tracking and payment transfer only. The system has no responsibility or liability to track, collect, or remit taxes or any other payment outside the system. The system and its owner are acting on their own behalf, for their own benefits, except where explicitly expressed otherwise.

Membership is private and for rewards program use only.  No public offering are being made within the website.  Members agree to use this information on the website for their own personal use, or in the case of a business for business use, and not for the use of any other public agency or government body.

The data on this site is for informational and promotional use only.  In no way is the information a solicitation for sale of any securities.

Use, application, or registration of this site constitutes consent to current and future terms and conditions. Terms and conditions can change at any time without notice, but will be posted to this webpage.

Points have no cash value, but can be redeemed for rewards through our program. Businesses agree to paying the fee associated with providing these rewards to their clients. Agents and businesses who collect commissions and referral fees through the system agree to pay a fee associated with the processing and automation of this compensation. We act as agent processing these transactions, not as principle. In the event there is a disagreement between the parties, dispute resolution will be arbitrated between us, the agent and the supplier.  We are not liable for any outcome of using this system.
